SPECIFICS OF WORKING WITH CONTRACTUAL DOCUMENTATION IN THE DEPARTMENT OF CONTINUING PROFESSIONAL EDUCATION OF THE NATIONAL RESEARCH UNIVERSITY «BELSU»
ABSTRACT
Department of Continuing Professional Education (DNPO) BelSU National Research University plays a key role in the implementation of additional educational programs. The Department addresses the needs of a wide range of students, from students in need of additional qualifications to specialists seeking to improve their professional level. The successful functioning of the DNPO is based on a complex system of contractual relations that require a special approach to the preparation, coordination and execution of contractual documentation.

The Department of Continuing Vocational Education (DNGO) of NIU "BelGU" plays a key role in implementing additional educational programs. The Department is closing the needs of a wide range of audiences, from students who need additional skills to professionals seeking to improve their skills. The successful functioning of the DGNO is underpinned by a complex system of treaty relations that requires special treatment in the drafting, coordination and implementation of contract documentation.
Work with contracts in the NGU "BelGU" has a number of characteristic features, which are due to the specific activities of the department, the legal status of the university and the requirements of legislation.
First of all, consider the legal and regulatory framework on which staff rely when drafting contracts:
- Federal Law of 29.12.2012 273-FZ "On education in the Russian Federation" - defines general requirements for the implementation of educational programs and formalization of relations between educational organization and students.
- The Civil Code of the Russian Federation (Chapter 39 on service provision with compensation) - regulates contractual relations.
- Federal Law of 27.07.2006 152-FZ "On personal data".
- Internal local acts of the NIU "BelGU": position of the department of continuing professional education, regulations on contract formalization, orders of the rector.
Also in the Department of Continuing Vocational Education, various types of contracts are concluded, each with its own nuances.
The first type is contracts for paid educational services. This is the main type of contracts concluded with individuals for further vocational education or professional retraining. They regulate the rights and obligations of the parties and the content of educational programs, terms of study, cost of services, payment procedure and responsibility for failure to fulfill obligations.
The following are contracts with legal entities. The department can contract organizations to train its employees. Such agreements may include terms on corporate discounts, individual training programs and customer reporting.
The third type is expenditure contracts. By hiring qualified external trainers, the department must contract with them to determine their remuneration, scope of work, duration of contract, obligations and accountability.
Additional agreements are also created to make changes to existing contracts (adjustment of terms, costs, list of services).
In order to ensure uniformity and reduce risks when working with contract documents, DNGO uses standardized contract forms developed by the University’s legal service. This allows: - to follow a unified approach, ensuring compliance with the requirements of legislation and domestic regulations; - Speed up the process, as the template forms contain already developed language, which reduces the time to develop them; - reduce the likelihood of missing important points or incorrect wording. However, not all treaties are made in the typical form of the university. If an organization sends its contract, it must pass the inspection of the legal department, after which the lawyer stamps the copy of the NIU "BelGU". Also, if the lawyer has not approved the contract, it must include all the changes that have been specified by the legal department. Next, we propose to consider the stages of work with the contract documentation.
1. Preparation of a draft treaty. The standard form is being developed, taking into account the requirements of legislation and internal regulations. Conditions are specified, which include the name of the program, duration of training, amount, order of payment, rights and obligations of the parties. If the template differs from the standard university form, then the agreement passes the approval phase by the legal department of the NIU "BelGU".
2. Agreement and signature. At this stage: submission of the application, verification of the accuracy of personal data, signing of the contract by the trainees and vice-rector of the department of continuing professional education.
3. Registration and accounting. The contract is assigned a registration number, data are entered into the single database of contracts of the NIU "BelGU" - 1C Omega: Management of the FHD.
4. Execution of the contract. At this stage, payment and start dates are monitored, as well as the implementation of the educational program (attendance, academic performance). Certificates of services performed are drawn up.
5. Transfer of contract documents to the archive.
Work with contract documentation in the department of continuing professional education of NIU "BelGU" is a multifaceted process, requiring deep knowledge of legislation, developed internal procedures and high level of professionalism of all involved parties. Effective management of contracts is the key to successful implementation of educational programs, protection of university interests and ensuring high quality of educational services provided. Continuous improvement of the regulatory framework, automation of processes and upgrading of skills of employees involved in contractual work will allow the department of continuing professional education of NIU "BelGU" to further develop successfully, Meeting the pressing needs of the labor market and society as a whole.
